The Board of Adjustment
is the board of “non-permitted uses”, which are known as
variances from the Township’s Land Use ordinances. The
Board of Adjustment is a quasi-judicial body, appointed by
the Township Committee.
Variances that would be
reviewed are often either “C” (Bulk/Hardship) or “D” (Use)
variances. Simply by applying to the Board, the applicant
is not entitled the variance. It is the responsibility of
the applicant to provide sufficient proof that the variance
should be granted. Examples of such proof would include
special reasons, hardship, positive and negative criteria.
The Board of
Adjustment is also responsible for hearing appeals of
decisions of the municipal zoning official regarding land
use matters. They can also interpret the zoning map and
Land Use Ordinances.
